Terms of Use

Astral Messenger is an online service offering a personal guidance tool that allows users to ask questions and receive inspired, symbolic, and introspective answers.

Astral Messenger is intended to support the user's personal reflection and in no way claims to provide absolute truths, factual predictions, or decisions to be made.

Use of the Astral Messenger service implies full and complete acceptance of these Terms of Use.

The user acknowledges having read the Terms before any use of the service and accepts them without reservation.

Astral Messenger is accessible via a web interface. Some features require:

• Creating a user account
• Purchasing Auras
• Subscribing to a plan

The publisher reserves the right to modify, suspend, or discontinue all or part of the service.

Astral Messenger offers personal guidance responses based on symbolic interpretation and perspective on questions expressed by the user.

• The service is not a factual predictive service
• The service does not guarantee any results
• The service does not constitute objective or universal truth

The user remains fully responsible for their decisions, actions, and interpretations.

Astral Messenger does not replace in any case:

• Medical or paramedical advice
• Psychological or psychiatric support
• Legal advice
• Financial or wealth management advice

The user acknowledges using the service for personal reflection and well-being purposes, under their sole responsibility.

The user agrees to:

• Use the service in a personal and reasonable manner
• Not seek answers regarding critical or vital decisions
• Not use the service for illegal, hateful, violent, or fraudulent content

Any abusive use or use contrary to these Terms may result in account suspension or deletion.

Auras are an internal virtual currency providing access to guidance features. A guidance message consumes a defined number of Auras. Auras have no legal or monetary value outside the service.

Auras can be acquired through packs or a recurring subscription.

Purchased Auras are non-refundable and non-exchangeable, except as required by law.

The Astral+ subscription provides periodic Auras and associated benefits.

• The subscription is commitment-free
• It can be cancelled at any time from the user space
• Cancellation takes effect at the end of the current billing period

Payments are processed through secure payment providers (Stripe).

All prices are displayed in euros (€) and include all applicable taxes (TTC / VAT included). The total price payable is shown before order confirmation.

Astral Messenger does not store any banking data.

After each payment, the user receives an order confirmation email, on a durable medium, containing the essential pre-contractual information, in accordance with article L221-13 of the French Consumer Code.

Any fraud or attempted fraud will result in immediate suspension of the account.

In accordance with article L221-5 of the French Consumer Code, the publisher provides the user, prior to any order, with the following essential information:

• Identity of the seller: FACTORIZE (EURL, RCS 922 530 639, 14 rue de la Lys, 59181 Steenwerck, France) and MAXKEN (SARL, RCS 821 612 611, 34 place du Général de Gaulle, 59800 Lille, France), operating through the ASTRALMESSENGER interface.
• Essential characteristics: access to an automated guidance service generating text responses via artificial intelligence, in exchange for Auras (an internal virtual currency).
• Total price payable: shown in euros, all taxes included (VAT inclusive), before order validation.
• Payment methods: bank card via the provider Stripe.
• Performance: Auras are credited to the user's account immediately upon payment confirmation.
• Contract duration: none for packs (one-off purchases); automatic monthly renewal for the Astral+ subscription, which can be cancelled at any time at no cost from the user area.

In accordance with article L221-18 of the French Consumer Code, the consumer user is in principle entitled to a 14-day cooling-off period to exercise their right of withdrawal for distance contracts.

However, in accordance with article L221-28 1° of the French Consumer Code, this right cannot be exercised for contracts for the supply of digital content not provided on a tangible medium whose performance has begun after the consumer's prior express consent and express waiver of their right of withdrawal.

Before each Aura pack purchase or Astral+ subscription, the user:

• Gives express consent for the immediate performance of the service;
• Expressly acknowledges waiving their 14-day right of withdrawal.

Both acknowledgements are collected via an explicit and mandatory checkbox before payment is validated.

The ASTRALMESSENGER service qualifies as digital content and a digital service within the meaning of articles L224-25-1 et seq. of the French Consumer Code.

The consumer user benefits from the statutory guarantee of conformity provided by these articles. The publisher is liable for any lack of conformity existing at the time the service is supplied and appearing within two years from that supply for content delivered as a one-off, or throughout the duration of the contract for services supplied continuously (subscription).

This statutory guarantee applies independently of any commercial guarantee that may be granted.

Astral Messenger collects and processes personal data in accordance with applicable regulations (GDPR).

The terms of processing, retention, and deletion of data are detailed in the Privacy Policy, accessible on the site.

Conversations are treated as confidential.

However, the user acknowledges that exchanges may be automatically processed and temporarily stored for technical or service improvement purposes, in compliance with applicable regulations.

Astral Messenger uses advanced digital technologies to generate its responses, within a personal guidance framework.

These technologies do not constitute a human entity and have no consciousness of their own.

All content, branding, texts, interfaces, and features of Astral Messenger are protected by intellectual property law.

Any unauthorized reproduction, modification, or exploitation is strictly prohibited.

Astral Messenger shall not be held liable for interpretations made by the user, decisions made following use of the service, or any indirect damages related to the use of the service.

The publisher's liability is limited to the strict applicable legal framework.

Astral Messenger reserves the right to suspend or terminate a user account in case of violation of the Terms, abusive or fraudulent use, or behavior contrary to the spirit of the service.

These Terms may be modified at any time.

The user will be informed of any substantial modification. Continued use of the service constitutes acceptance of the new Terms.

These Terms are governed by French law.

In case of dispute, the parties will seek an amicable solution before any legal action.

In accordance with articles L611-1 et seq. of the French Consumer Code, a consumer user may, after a prior attempt to resolve the dispute with customer support (contact@astralmessenger.com), use a consumer mediator free of charge.

Designated mediator: (to be completed, designation in progress with a mediator listed by the French Commission for the evaluation and control of consumer mediation).
