Terms of Use

Astral Messenger is an online service offering a personal guidance tool that allows users to ask questions and receive inspired, symbolic, and introspective answers.

Astral Messenger is intended to support the user's personal reflection and in no way claims to provide absolute truths, factual predictions, or decisions to be made.

Use of the Astral Messenger service implies full and complete acceptance of these Terms of Use.

The user acknowledges having read the Terms before any use of the service and accepts them without reservation.

Astral Messenger is accessible via a web interface. Some features require:

• Creating a user account
• Buying extra messages, consultation minutes or, where applicable, free access for a fixed duration
• Subscribing to a plan

The publishers reserve the right to modify, suspend, or discontinue all or part of the service.

Astral Messenger offers personal guidance responses based on symbolic interpretation and perspective on questions expressed by the user.

• The service is not a factual predictive service
• The service does not guarantee any results
• The service does not constitute objective or universal truth

The user remains fully responsible for their decisions, actions, and interpretations.

Astral Messenger does not replace in any case:

• Medical or paramedical advice
• Psychological or psychiatric support
• Legal advice
• Financial or wealth management advice

The user acknowledges using the service for personal reflection and well-being purposes, under their sole responsibility.

The user agrees to:

• Use the service in a personal and reasonable manner
• Not seek answers regarding critical or vital decisions
• Not use the service for illegal, hateful, violent, or fraudulent content

Any abusive use or use contrary to these Terms may result in account suspension or deletion.

One message sent uses one unit, however long it is. The service grants a number of free messages on arrival, then one free question per period. That period lengthens as free questions are used: twenty-four hours for the first ones, then forty-eight hours, then one week. Free questions never stop, and any purchase resets the period to its initial value. The free question is tied to the device: accounts used on the same device share a single free question, and their period is calculated on all the questions they have used. Accounts that have made a purchase are not affected. During a subscription, the included messages replace the free question.

Each weekly or monthly subscription plan includes, unless it gives free access, a number of messages per day, shown before subscribing, renewed every day at 6:00 am; included messages not used during the day do not carry over. Included messages are used first. When they run out, the subscriber can wait for them to be renewed or, if it is offered to them, buy a top-up of extra messages, paid once; no overage is ever charged automatically. Purchased messages never expire and remain usable after the subscription ends.

Free access, during which messages sent are not counted, may also be offered: for a fixed duration, shown before purchase, paid once and without automatic renewal; or through a free-access subscription, renewed at each due date and cancellable under the conditions of article 8.

The offers available to each user, subscribed or not (subscription plans, message top-up, minute top-up, free access), together with their price and conditions, are shown before purchase. The top-up may be reserved for subscribers.

Free access purchased before plans with included messages were introduced (24-hour access, Astral+ subscription) remains honoured under the terms of its purchase.

The service applies technical rate limits intended to prevent automated use. They are calibrated so as not to be reached by normal personal use, and may delay or refuse a send.

Purchased messages, included messages and subscription or free-access periods are neither refundable nor exchangeable, unless the law provides otherwise.

A minute top-up credits the account with a balance of consultation minutes, stated before purchase. This balance can be used in one or more sessions, with no expiry date.

Time is only counted, to the second, during a session opened from the conversation, with no minimum charge. Counting stops when the user ends the session, leaves or closes the page; with no sign of presence for more than one minute, the session is closed. In every case, the remaining balance is kept.

The "First consultation" is offered only once per account, to accounts that have never bought minutes. The free minutes it includes are counted like the others.

When the balance reaches zero, the session ends; the user may buy a new top-up to continue. If minute top-ups stop being offered, the balance already acquired remains usable until it runs out.

Purchased or free minutes are neither refundable nor exchangeable, unless otherwise required by law.

The subscription is offered weekly or monthly, at the price shown before subscribing. It includes messages every day or, for a free-access subscription, free access to the service, under the conditions of article 7.

• The subscription is commitment-free and renews automatically at each due date (every seven days or every month, depending on the plan), at the price shown when subscribing, until it is cancelled
• It can be cancelled at any time from the user space (“My subscription”), free of charge, without giving a reason and without contacting support
• Cancellation takes effect at the end of the period already paid: access and included messages remain available until that date, and no further payment is taken
• The subscriber can change plan from “My subscription”, among the plans offered to them. Moving to a plan with a higher price per billing period (for example from weekly to monthly) takes effect immediately: the unused part of the current period is deducted from the amount charged that day; this amount and the next due date are shown before confirmation. Any other plan change takes effect at the end of the period already paid, without refund, and can be cancelled until then.
• Subscription is confirmed by email, as is cancellation made from “My subscription”; a reminder is sent a few days before each renewal of a monthly subscription

Payments are processed through secure payment providers (Stripe).

All prices are displayed in euros (€) and include all applicable taxes (TTC / VAT included). The total price payable is shown before order confirmation.

Astral Messenger does not store any banking data.

After each payment, the user receives an order confirmation email, on a durable medium, containing the essential pre-contractual information, in accordance with article L221-13 of the French Consumer Code.

Any fraud or attempted fraud will result in immediate suspension of the account.

In accordance with article L221-5 of the French Consumer Code, the publishers provide the user, prior to any order, with the following essential information:

• Identity of the seller: FACTORIZE (EURL, RCS 922 530 639, 14 rue de la Lys, 59181 Steenwerck, France), operating through the ASTRALMESSENGER interface, is the contracting seller; it invoices and collects payments in its own name. MAXKEN (SARL, RCS 821 612 611, 34 place du Général de Gaulle, bureau 3, 59800 Lille, France), joint publisher of the service, undertakes joint and several liability with FACTORIZE towards the user for the performance of the service, refunds due and statutory guarantees.
• Essential characteristics: access to an automated guidance service generating text answers via artificial intelligence, as messages counted individually, as consultation minutes counted to the second, as a subscription including messages every day or, where applicable, as free access, for a fixed duration or by subscription.
• Total price payable: shown in euros, all taxes included (VAT inclusive), before order validation.
• Payment methods: bank card via the provider Stripe.
• Performance: purchased messages or minutes are credited immediately, and the subscription and its included messages or, where applicable, the free access open immediately, upon payment confirmation.
• Contract duration: none for a message or minute top-up (one-off purchase); where applicable, the duration shown before purchase, without renewal, for free access for a fixed duration; automatic renewal every week or every month for the subscription, depending on the plan chosen, cancellable at any time free of charge from the user space.

In accordance with article L221-18 of the French Consumer Code, the consumer user is in principle entitled to a 14-day cooling-off period to exercise their right of withdrawal for distance contracts.

However, in accordance with article L221-28 1° of the French Consumer Code, this right cannot be exercised for contracts for the supply of digital content not provided on a tangible medium whose performance has begun after the consumer's prior express consent and express waiver of their right of withdrawal.

Before each purchase of a top-up (messages or minutes) or, where applicable, of free access for a fixed duration, each subscription to a plan and each plan change taking effect immediately, the user:

• Gives express consent for the immediate performance of the service;
• Expressly acknowledges waiving their 14-day right of withdrawal.

Both acknowledgements are collected via an explicit and mandatory checkbox before payment is validated.

The ASTRALMESSENGER service qualifies as digital content and a digital service within the meaning of articles L224-25-1 et seq. of the French Consumer Code.

The consumer user benefits from the statutory guarantee of conformity provided by these articles. The publishers are liable for any lack of conformity existing at the time the service is supplied and appearing within two years from that supply for content delivered as a one-off, or throughout the duration of the contract for services supplied continuously (subscription).

This statutory guarantee applies independently of any commercial guarantee that may be granted.

Astral Messenger collects and processes personal data in accordance with applicable regulations (GDPR).

The terms of processing, retention, and deletion of data are detailed in the Privacy Policy, accessible on the site.

Conversations are treated as confidential.

However, the user acknowledges that exchanges may be automatically processed and temporarily stored for technical or service improvement purposes, in compliance with applicable regulations.

Astral Messenger uses advanced digital technologies to generate its responses, within a personal guidance framework.

These technologies do not constitute a human entity and have no consciousness of their own.

All content, branding, texts, interfaces, and features of Astral Messenger are protected by intellectual property law.

Any unauthorized reproduction, modification, or exploitation is strictly prohibited.

Astral Messenger shall not be held liable for interpretations made by the user, decisions made following use of the service, or any indirect damages related to the use of the service.

The publishers' liability is limited to the strict applicable legal framework.

Astral Messenger reserves the right to suspend or terminate a user account in case of violation of the Terms, abusive or fraudulent use, or behavior contrary to the spirit of the service.

These Terms may be modified at any time.

The user will be informed of any substantial modification. Continued use of the service constitutes acceptance of the new Terms.

These Terms are governed by French law.

In case of dispute, the parties will seek an amicable solution before any legal action.

In accordance with articles L611-1 et seq. of the French Consumer Code, a consumer user may, after a prior attempt to resolve the dispute with customer support (contact@astralmessenger.com), use a consumer mediator free of charge.

Designated mediator: (to be completed, designation in progress with a mediator listed by the French Commission for the evaluation and control of consumer mediation).
